Wheelie bins left out on the street permanently could lead to more than just complaints

Bins left sitting outside for days at a time can cause more problems than many people expect. But while it may seem like a minor annoyance, councils do have powers they can use when complaints start to pile up.

As per government guidance, councils can act when bins and rubbish “cause or are likely to cause a nuisance” or negatively affect the local area. Official rules state this can include when they cause an obstruction to pavements for several days, or if the waste attracts vermin like rats and foxes.

The Department for Environment, Food & Rural Affairs (Defra) says councils should usually try to resolve issues informally before issuing penalties. Guidance explains authorities may first send warning letters or information notices before escalating enforcement action.

Government rules also make clear councils should not issue penalties for “minor problems” such as bins being left out for a few hours after collection. However, repeated issues causing obstruction or environmental disturbances can lead to formal action under the Environmental Protection Act 1990.

Southampton City Council, for example, states that bins left on pavements can obstruct wheelchair users, pushchairs and visually impaired pedestrians. It goes on to warn how the neighbourhood nuisance can increase risks of fly-tipping, vandalism and littering.

Then there’s Wigan Council which says that bins should usually return to property boundaries by midnight on collection day. Not doing so is a fire hazard, it claims.

Whereas Bath and North East Somerset Council urge residents to bring bins back in “as soon as possible”. Similar guidance is used by councils across England and Wales to reduce street obstructions and nuisance complaints.

The Government adds that councils can issue fixed penalty notices where bins repeatedly create obstructions or damage local amenities. Rules specifically mention waste receptacles left out for several days as an example that may justify enforcement.

Experts say most disputes over bins are resolved informally before formal enforcement becomes necessary. Councils encourage neighbours to speak politely first because many residents may not realise they are causing a problem.

Online discussions also show how frustrating permanently left-out bins can become in residential streets. In one Reddit thread on HousingUK, a resident complained rubbish regularly blew into the road because a neighbour’s bins were “out all the time”.

Importantly, councils cannot usually fine people immediately without following a legal process first. Government guidance states households should normally receive warnings and the opportunity to correct the issue before fixed penalties are considered.
