Man discharged in fake currency case | Thane News

THANE: The sessions court in its recent order discharged a man who was accused of possessing counterfeit currency notes 11 years ago.

In his plea, the accused’s lawyer pointed out that there is no single witness in the case, and he has been arrested only on the basis of statement of co-accused which is inadmissible in the eyes of law.

Also, there is no material on record to indicate that there are sufficient grounds to proceed against him.
The prosecution contended, however, urged to reject the discharge plea. Assistant sessions judge GT Pawar noted, “For framing charges, the court has to consider whether a prima facie case is made out against the accused or not.

Simultaneously, it has to be kept in mind that whether the accusation is merely on the basis of suspicion or there is strong suspicion that the accused has committed the offence, adding that investigating officer has not collected any material to show the involvement of the accused in the alleged offence except that there is another case against him.
